Where Was the Tea Party?

One of the great questions about the 2012 campaign has been “Where was the tea party?” They were not the fierce force they’d been in the 2010 cycle, when Republicans took back the House. Some of us think the answer to the question is: “Targeted by the IRS, buried under paperwork and unable to raise money.”

The economist Stan Veuger, on the American Enterprise Institute‘s blog, takes the question a step further.

The Democrats had been badly shaken by the Republican comeback of 2010. They feared a repeat in 2012 that would lose them the White House.

Might targeting the tea-party groups—diverting them, keeping them from forming and operating—seem a shrewd campaign strategy in the years between 2010 and 2012? Sure. Underhanded and illegal, but potentially effective.

Veuger writes: “It is a well-known fact that the Tea Party movement dealt the president his famous “shellacking” in the 2010 midterm election. Less well-known is the actual number of votes this new movement delivered—and the continuing effects these votes could have had in 2012 had the movement not been demobilized by the IRS.”

The research paper Veurger and his colleagues have put out notes that, in Veuger’s words, “the Tea Party movement’s huge success [in 2010] was not the result of a few days of work by an elected official or two, but involved activists all over the country who spent the year and a half leading up to the midterm elections volunteering, organizing, donating, and rallying. Much of these grassroots activities were centered around 501(c)4s, which according to our research were an important component of the Tea Party movement and its rise.”

More: “The bottom line is that the Tea Party movement, when properly activated, can generate a huge number of votes—more votes in 2010, in fact, than the vote advantage Obama held over Romney in 2012. The data show that had the Tea Party groups continued to grow at the pace seen in 2009 and 2010, and had their effect on the 2012 vote been similar to that seen in 2010, they would have brought the Republican Party as many as 5-8.5 million votes compared to Obama’s victory margin of 5 million.”

Think about the sheer political facts of the president’s 2012 victory. The first thing we learned, in the weeks after the voting, was that the Obama campaign was operating with a huge edge in its technological operation—its vast digital capability and sophistication. The second thing we learned, in the past month, is that while the campaign was on, the president’s fiercest foes, in the Tea Party, were being thwarted, diverted and stopped.

Technological savvy plus IRS corruption. The president’s victory now looks colder, more sordid, than it did. Which is why our editor, James Taranto, calls him “President Asterisk.”

The Era of Metadata

Five blunt thoughts on the growing surveillance state:

1. The thing political figures fear most is a terror event that will ruin their careers. The biggest thing they fear is that a bomb goes off and it can be traced to something they did or didn’t do, an action they did or didn’t support. They all fear being accused of not doing enough to keep the citizenry safe.

This is true of Republicans and Democrats. Their anxiety has no ideology. They all fear being the incumbent in the election in which the challenger says, in a debate: “That’s all well and fine, Senator, we’re sure you’re upset at what happened. But at the moment it counted, when you could have supported all efforts to keep the people safe and bust the terror network, you weren’t there. You were off giving lectures on what you call civil liberties, and explaining why you were voting ‘no.’ Well, life is a civil liberty—and now a thousand people are dead.” Nobody wants to be that incumbent.

Because of that primal political fear, there is a built-in bias within the U.S. government toward doing too much and not too little. There is a built-in bias toward using too much muscle, too much snooping, too much gathering of data. The bias is toward overreach. The era of metadata encourages all this: There’s always more information to be got.

Presidents are very much part of this, as are congressmen, and judges too. Nobody wants to be the judge who didn’t sign off on the request that could arguably have impeded the network that put the dirty bomb on 42nd and Eighth. No one wants to be the judge whose name the U.S. intelligence agencies leak to the press as the real culprit, the real reason they couldn’t stop the bad guys. “Judge Murphy was generally seen as a loner on the bench, a man more drawn to horticultural pursuits and abstruse comment-thread debate on the history of the Fourth Amendment than evenings out with colleagues on the court and in the local bar association. ‘He’s about to discover why people have friends,’ said a court worker who spoke anonymously in order not to appear to be taking sides in the growing controversy. ‘I hope he survives this, even in a diminished capacity, because in a way the law benefits from his kind of detachment and ethereal approach.’” Nobody wants to be Judge Murphy.

Because of the built-in bias in the system—the bias to do too much, to go too far—the creation of an invasive American surveillance state is probably inevitable. Politicians are people who can do math. The number of people who want to be safe, they are certain, is far greater than the number worried about abstract issues of privacy. Moreover, they figure voters are more or less like this: They’ll have their little blog debates about privacy right up until a bomb goes off, and then they’ll all go into a swivet and join a new chorus: “Why didn’t you protect me? Throw the bums out!”

2. There is no way a government in the age of metadata, with the growing capacity to listen, trace, tap, track and read, will not eventually, and even in time systematically, use that power wrongly, maliciously, illegally and in areas for which the intelligence gathering was never intended. People are right to fear that the government’s surveillance power will be abused. It will be. There are many reasons for this, but the primary one is that humans are and will be in charge of it, and humans have shown throughout history a bit of a tendency to play every trick and bend and break laws. “If men were angels,” as James Madison wrote, limits, checks, balances and specifically protected rights would not be necessary. But they aren’t angels. Add to all this simple human mistakes, innocent and not, and misjudgments. And add to that sheer human craziness, partisan lust, political mischief of all sorts. In the Clinton White House there was a guy named Craig Livingstone who amused himself reading aloud the confidential FBI files of prominent Republicans. The files—hundreds of them—were improperly secured and disseminated. Imagine Craig Livingstone at the National Security Agency. Imagine Lois Lerner.

So if we have and develop a massive surveillance state, it will be abused. And that abuse will, down the road, do damage not only to individuals but, quite probably, to the nation’s morale, to its very vision of itself.

But it will make us – or allow us to feel — physically safer. And it may help break real terror networks bent on real mayhem.

3. The president said Friday, in his remarks on the NSA surveillance story: “I think it’s important to recognize that you can’t have 100% security and also then have 100% privacy and zero inconvenience.”

But is that really the trade-off? Will a surveillance state make us 100% safer? It let the Tsarnaevs through. We had the surveillance state when they set off their bombs at the Boston Marathon. We’d even been tipped by the Russians to watch them. The surveillance state didn’t thwart the Fort Hood massacre. Maybe in the end we’ll find the surveillance state is massive, cumbersome, costly, potentially helpful, certainly powerful, menacing and yet not always so effective.

4. The president said the recently revealed programs are subject to congressional oversight, which will help keep them from getting out of hand. But that sounded more like a Washington inside joke than a comfort. Congressional oversight of executive agencies has been chronically lacking and lackluster for years. If you are a congressman oversight is, generally, an unrewarded time-suck. It’s housekeeping that demands deep bureaucratic, accounting and now technological expertise. (“Thank you for providing the email records, but is there any chance you have secret email accounts that aren’t included here?”) And usually nobody knows about your good work—it yields little in the way of credit.

Oversight is time taken away from fundraising calls, from the four-minute hit on “Hardball” or Fox, from the urgent call with the important constituent, from time in the gym where you hide from your staff. And Congress isn’t even in Washington often enough to establish ready and present oversight—members work from Monday through Thursday, and then go home to meet with people and show they’re normal. That’s part of the reason the Internal Revenue Service thought it could function as a political entity—they didn’t fear oversight. The General Services Administration on its champagne-soaked boondoggles—they didn’t fear oversight. Do the technicians, data miners, lawyers and technology officers in the NSA warehouses fear oversight?

Props here to Darrell Issa: He does oversight. But his work is exceptional because it is the exception. And congressional oversight still leads us back to where we began: the built-in bias toward doing too much.

5. The security age began on Sept. 12, 2001. The enormity of the surveillance state since has grown. Americans, in the shock after 9/11, didn’t mind enhanced security, and in fact were mostly grateful for it and supportive of it. But built into that support, and the acceptance of the surveillance mentality’s intrusions, was I suspect a broadly held assumption that we’ll just do it now, and down the road we can stop it. It’s just an emergency thing. We can make it go away when we no longer want it. But can we? Do government programs tend to remain static, or wither? Or do they tend to grow?

The IRS Can’t Plead Incompetence

Quickly: Everyone agrees the Internal Revenue Service is, under current governmental structures, the proper agency to determine the legitimacy of applications for tax-exempt status. Everyone agrees the IRS has the duty to scrutinize each request, making sure that the organization meets relevant criteria. Everyone agrees groups requesting tax-exempt status must back up their requests with truthful answers and honest information.

Some ask, “Don’t conservatives know they have to be questioned like anyone else?” Yes, they do. Their grievance centers on the fact they have not been. They were targeted, and their rights violated

The most compelling evidence of that is what happened to the National Organization for Marriage. Its chairman, John Eastman, testified before the House Ways and Means Committee, and the tale he told was different from the now-familiar stories of harassment and abuse.

In March 2012, the organization, which argues the case for traditional marriage, found out its confidential tax information had been obtained by the Human Rights Campaign, one of its primary opponents in the marriage debate. The HRC put the leaked information on its website—including the names of NOM donors. The NOM not only has the legal right to keep its donors’ names private, it has to, because when contributors’ names have been revealed in the past they have been harassed, boycotted and threatened. This is a free speech right, one the Supreme Court upheld in 1958 after the state of Alabama tried to compel the NAACP to surrender its membership list.

The NOM did a computer forensic investigation and determined that its leaked IRS information had come from within the IRS itself. If it was leaked by a worker or workers within the IRS it would be a federal crime, with penalties including up to five years in prison.

In April 2012, the NOM asked the IRS for an investigation. The inspector general’s office gave them a complaint number. Soon they were in touch. Even though the leaked document bore internal IRS markings, the inspector general decided that maybe the document came from within the NOM. The NOM demonstrated that was not true.

For the next 14 months they heard nothing about an investigation. By August 2012, the NOM was filing Freedom of Information Act requests trying to find out if there was one. The IRS stonewalled. Their “latest nonresponse response,” said Mr. Eastman, claimed that the law prohibiting the disclosure of confidential tax returns also prevents disclosure of information about who disclosed them. Mr. Eastman called this “Orwellian.” He said that what the NOM experienced “suggests that problems at the IRS are potentially far more serious” than the targeting of conservative organizations for scrutiny.

In hearings Thursday, Rep. Elijah Cummings, a Maryland Democrat who disagrees with the basic stand of the NOM, said that what had happened to the organization was nonetheless particularly offensive to him. The new IRS director agreed he would look into it.

Almost a month after the IRS story broke—a month after the high-profile scandal started to unravel after a botched spin operation that was meant to make the story go away—no one has been able to produce a liberal or progressive group that was targeted and thwarted by the agency’s tax-exemption arm in the years leading up to the 2012 election. The House Ways and Means Committee this week held hearings featuring witnesses from six of the targeted groups. Before the hearing, Republicans invited Democrats to include witnesses from the other side. The Democrats didn’t produce one. The McClatchy news service also looked for nonconservative targets. “Virtually no organizations perceived to be liberal or nonpartisan have come forward to say they were unfairly targeted,” it reported. Liberal groups told McClatchy “they thought the scrutiny they got was fair.”

Some sophisticated Democrats who’ve worked in executive agencies have suggested to me that the story is simpler than it seems—that the targeting wasn’t a political operation, an expression of political preference enforced by an increasingly partisan agency, its union and assorted higher-ups. A former senior White House official, and a very bright man, said this week he didn’t believe it was mischief but incompetence. But why did all the incompetent workers misunderstand their jobs and their mission in exactly the same way? Wouldn’t general incompetence suggest both liberal and conservative groups would be abused more or less equally, or in proportion to the number of their applications? Wouldn’t a lot of left-wing groups have been caught in the incompetence net? Wouldn’t we now be hearing honest and aggrieved statements from indignant progressives who expected better from their government?

Some person or persons made the decision to target, harass, delay and abuse. Some person or persons communicated the decision. Some persons executed them. Maybe we’re getting closer. John McKinnon and Dionne Searcey of The Wall Street Journal reported this week that IRS employees in the Cincinnati office—those are the ones that tax-exempt unit chief Lois Lerner accused of going rogue and attempted to throw under the bus—have told congressional investigators that agency officials in Washington helped direct the probe of the tea-party groups. Mr. McKinnon and Ms. Searcey reported that one of the workers told investigators an IRS lawyer in Washington, Carter Hull, “closely oversaw her work and suggested some of the questions asked applicants.”

“The IRS didn’t respond to a request for comment,” they wrote. There really is an air about the IRS that they think they are The Untouchables.

Some have said the IRS didn’t have enough money to do its job well. But a lack of money isn’t what makes you target political groups—a directive is what makes you do that. In any case, this week’s bombshell makes it clear the IRS, from 2010 to 2012, the years of prime targeting, did have money to improve its processes. During those years they spent $49 million on themselves—on conferences and gatherings, on $1,500 hotel rooms and self-esteem presentations. “Maliciously self-indulgent,” said Chairman Darrell Issa at Thursday’s House Oversight and Government Reform Committee hearings.

What a culture of entitlement, and what confusion it reveals about what motivates people. You want to increase the morale, cohesion and self-respect of IRS workers? Allow them to work in an agency that is famous for integrity, fairness and professionalism. That gives people spirit and guts, not “Star Trek” parody videos.

Finally, this week Russell George, the inspector general whose audit confirmed the targeting of conservative groups, mentioned, as we all do these days, Richard Nixon’s attempt to use the agency to target his enemies. But part of that Watergate story is that Nixon failed. Last week David Dykes of the Greenville (S.C.) News wrote of meeting with 93-year-old Johnnie Mac Walters, head of the IRS almost 40 years ago, in the Nixon era. Mr. Dykes quoted Tim Naftali, former director of the Nixon Presidential Library and Museum, who told him the IRS wouldn’t do what Nixon asked: “It didn’t happen, not because the White House didn’t want it to happen, but because people like Johnnie Walters said ‘no.’ ”

That was the IRS doing its job—attempting to be above politics, refusing to act as the muscle for a political agenda.

An Antidote to Cynicism Poisoning Restoring public faith will require a full investigation of the IRS's politicization.

The Benghazi scandal was and is shocking, and the Justice Department assault on the free press, in which dogged reporters are tailed like enemy spies, is shocking. Benghazi is still under investigation and someday someone will write a great book about it. As for the press, Attorney General Eric Holder is on the run, and rightly so. They called it the First Amendment for a reason. But nothing can damage us more as a nation than what is happening at the Internal Revenue Service. Elite opinion in the press and in Washington doesn’t fully understand this. Part of the reason is that it’s not their ox being gored, it’s those messy people out in America with their little patriotic groups.

Those who aren’t deeply distressed about the IRS suffer from a reluctance or inability to make distinctions, and a lack of civic imagination.

The abuse was systemic—from the sheer number of targets and the extent of each targeting we know many workers had to be involved, many higher-ups, multiple offices. It was ideological and partisan—only those presumed to be of one political view were targeted. It has a single unifying pattern: The most vivid abuses took place in the years leading up to the president’s 2012 re-election effort. And in the end several were trying to cover it all up, including the head of the IRS, who lied to Congress about it, and the head of the tax-exempt unit, Lois Lerner, who managed to lie even in her public acknowledgment of impropriety.

It wasn’t a one-off. It wasn’t a president losing his temper with some steel executives. There was no enemies list, unless you consider half the country to be your enemies.

It is considered a bit of a faux pas to point this out, but what we are talking about in part is a Democratic president, a largely Democratic professional administrative class in Washington, and an IRS whose workers belong to a union whose political action committee gave roughly 95% of its political contributions last year to Democrats.

Tim Carney had a remarkable piece in the Washington Examiner this week in which he looked for campaign contributions from the IRS Cincinnati office. “In the 2012 election, every donation traceable to this office went to President Obama or liberal Sen. Sherrod Brown. ” An IRS employee said in an email to Mr. Carney, “Do you think people willing to sacrifice lucrative private sector careers to work in tax administration . . . are genuinely going to support the party directed by Grover Norquist?” Mr. Carney noted that one of his IRS correspondents had an interesting detail on his social media profile. He belongs to a Facebook group called “Target the Shutdown at the Tea Party States.” It advised the president, during the 2011 debt-ceiling fight: “For instance, shut down air traffic control at airports in Norfolk, Tampa, Nashville.”

Wow. I guess that was target practice.

Here is the thing. The politicization of government employees wouldn’t have worried a lot of us 40, 30 or even 20 years ago. But since then, as a country, we have become, as individuals, less respectful of political differences and even of each other, as everything—all parts of American life—has become more political, more partisan, more divided and more aggressive.

There has got to be some way to break through this, to create new rules for the road in a situation like this.

Because people think the IRS has always, in various past cases, been used as a political tool, they think we’ll glide through this scandal too. We’ll muddle through, we’ll investigate, the IRS will right itself, no biggie.

But when a scandal is systemic, ideological and focused on political ends, it will not just magically end. Agencies such as the IRS are part of what Jonathan Turley this week called a “massive administrative state,” one built with many protections and much autonomy.

If it is not forced to change, it will not.

Which gets us to the part about imagination. What does it mean when half the country—literally half the country—understands that the revenue-gathering arm of its federal government is politically corrupt, sees them as targets, and will shoot at them if they try to raise their heads? That is the kind of thing that can kill a country, letting half its citizens believe that they no longer have full political rights.

Those who think this is just business as usual are ahistorical, and those who think nothing can be done, or nothing serious should be done, are suffering from Cynicism Poisoning.

The House wants to proceed with hearings and an investigation itself, and understandably. One reason is pride. “We are the ones who got the IRS to do the audit,” a congressman said the other night. Another is momentum: An independent counsel would take time and take some air out of the story. But Congress is operating within a lot of political swirls. The IRS certainly doesn’t seem to fear them—haven’t its leaders made that clear in their testimony so far? Congress itself is not highly regarded by the public. Didn’t I say that politely?

Some members have been scared into thinking that tough hearings will constitute “overreach.” But when you spend all your time fearing overreach, you can forget to reach at all. A defensive crouch isn’t a good posture from which to launch a probe. And some members fear that if they pursue and give time to something that is not an economic issue, it will be used against them. But stopping the revenue-gathering arm of the federal government from operating as a hopelessly politicized and aggressive entity is an economic issue. It has to do with basic American faith in, and compliance with, half of the spending/taxing apparatus of the federal government. How could that not be an economic issue?

There will be more hearings next week, and fair enough. But down the road an independent counsel is going to be needed because the House does not have all the prosecutorial powers an independent counsel would—the powers to empanel a grand jury, grant immunity to potential witnesses, find evidence of criminal wrongdoing, indict.

Another reason to want an independent counsel: There are obviously many good, fair-minded workers in the IRS, people of sterling character. They deserve to be asked about what they were forced to put up with, what they felt they had to bite their tongues about.

There may even be a few stories about people who stood up and said: “You know you’re targeting Americans because they hold political views you don’t like, right? You know that’s wrong, right? And I’m not going to do it.”

It would be worth an investigation that breaks open the IRS to find that person, and that moment. You have no idea how much better it would make us feel, how inspiring and comforting, too.

An inability to make distinctions: “It’s always been like this.” “Presidents are always siccing the IRS on their enemies.” There’s truth in that. Why This Scandal Is Different

Sometimes when you’re writing part of a column you keep getting close to the meaning of what you want to say but you don’t quite get there, the full formulation of the idea eludes you. Then two days later, relaxing in conversation with friends, the thought comes to you whole, and you think: That’s what I meant to say. That’s what I was trying to get.

This week I had one of those moments. I kept trying, the paragraph kept not quite working, the deadline came.

I got an email last night that had the effect of a clarifying conversation. It was from a smart friend who works in government. He understood the point I was trying to make about how the current IRS scandal is different from previous ones and more threatening to the American arrangement. I had written that this scandal isn’t a discrete event in which a president picks up a phone and tells someone in the White House to look into the finances of some steel industry executives, or to check out the returns of some guy on an enemies list.

But my friend got to the essence. He wrote, “The left likes to say, ‘Watergate was worse!’ Watergate was bad—don’t get me wrong. But it was elites using the machinery of government to spy on elites. . . . It’s something quite different when elites use the machinery of government against ordinary people. It’s a whole different ball game.”

It is.

That’s exactly what I meant.

In previous IRS scandals it was the powerful abusing the powerful—a White House moving against prominent financial or journalistic figures who, because of their own particular status or the machineries at their disposal, could pretty much take care of themselves. A scandal erupts, there are headlines, and then people go on their way. The dreadful thing about this scandal, what makes it ominous, is that this is the elites versus regular citizens. It’s the mighty versus normal people. It’s the all-powerful directors of the administrative state training their eyes and moving on uppity and relatively undefended Americans.

That’s what makes this scandal different, and why if it’s not stopped now it will never stop. Because every four years you can get yourself a new president and a new White House, but you won’t easily get yourself a whole new administrative state. It’s there, it’s not going away, not anytime soon. If it isn’t forced back into its cage now, and definitively, it will prowl the land hungrily forever.

One more thing.

One of the reasons a lot of people in New York and Washington are not deeply distressed by the IRS targeting of conservative groups is that they have it in their heads that it only involved the tea party and the tea party is full of nuts, weirdoes and radicals whose discouragement wouldn’t be a grave national loss. It’s not only tea-party groups that were targeted, of course, but the IRS was only too happy to get the idea out there that it was. But if you’re the kind of person who thinks Tea Party people are low and extreme, that they’re the kind of people who’d hurt our country, take a few minutes to look at this. It’s a website that will take you to videos of a town hall meeting of the SouthWest Cincinnati Tea Party. It was held Wednesday night. Its subject was “IRS Intimidation—Are You Next?”

Do those people really strike you as weird and radical? Do they seem destructive? They are normal citizens. And they feel besieged.

A Battering Ram Becomes a Stonewall

“I don’t know.” “I don’t remember.” “I’m not familiar with that detail.” “It’s not my precise area.” “I’m not familiar with that letter.”

These are quotes from the Internal Revenue Service officials who testified this week before the House and Senate. That is the authentic sound of stonewalling, and from the kind of people who run Washington in the modern age—smooth, highly credentialed and unaccountable. They’re surrounded by legal and employment protections, they know how to parse a careful response, they know how to blur the essential point of a question in a blizzard of unconnected factoids. They came across as people arrogant enough to target Americans for abuse and harassment and think they’d get away with it.

So what did we learn the past week, and what are the essentials to keep in mind?

We learned the people who ran and run the IRS are not going to help Congress find out what happened in the IRS. We know we haven’t gotten near the bottom of the political corruption of that agency. We do not know who ordered the targeting of conservative groups and individuals, or why, or exactly when it began. We don’t know who executed the orders or directives. We do not know the full scope or extent of the scandal. We don’t know, for instance, how many applicants for tax-exempt status were abused.

We know the IRS commissioner wasn’t telling the truth in March 2012, when he testified: “There’s absolutely no targeting.” We have learned that Lois Lerner lied when she claimed she had spontaneously admitted the targeting in a Q-and-A at a Washington meeting. It was part of a spin operation in which she’d planted the question with a friend. We know the tax-exempt bureau Ms. Lerner ran did not simply make mistakes because it was overwhelmed with requests—the targeting began before a surge in applications. And Ms. Lerner did not learn about the targeting in 2012—the IRS audit timeline shows she was briefed in June 2011. She said the targeting was the work of rogue agents in the Cincinnati office. But the Washington Post spoke to an IRS worker there, who said: “Everything comes from the top.”

We know that Lois Lerner this week announced she’d done nothing wrong, and then took the Fifth.

And we know Jay Leno, grown interestingly fearless, said of the new IRS commissioner, “They’re called ‘acting commissioner’ because you have to act like the scandal doesn’t involve the White House.”

But the most important IRS story came not from the hearings but from Mike Huckabee’s program on Fox News Channel. He interviewed and told the story of Catherine Engelbrecht—a nice woman, a citizen, an American. She and her husband live in Richmond, Texas. They have a small manufacturing business. In the past few years she became interested in public policy and founded two groups, King Street Patriots and True the Vote.

In July 2010 she sent applications to the IRS for tax-exempt status. What followed was not the harassment, intrusiveness and delay we’re now used to hearing of. The U.S. government came down on her with full force.

In December 2010 the FBI came to ask about a person who’d attended a King Street Patriots function. In January 2011 the FBI had more questions. The same month the IRS audited her business tax returns. In May 2011 the FBI called again for a general inquiry about King Street Patriots. In June 2011 Engelbrecht’s personal tax returns were audited and the FBI called again. In October 2011 a round of questions on True the Vote. In November 2011 another call from the FBI. The next month, more questions from the FBI. In February 2012 a third round of IRS questions on True the Vote. In February 2012 a first round of questions on King Street Patriots. The same month the Bureau of Alcohol, Tobacco and Firearms did an unscheduled audit of her business. (It had a license to make firearms but didn’t make them.) In July 2012 the Occupational Safety and Health Administration did an unscheduled audit. In November 2012 more IRS questions on True the Vote. In March 2013, more questions. In April 2013 a second ATF audit.

All this because she requested tax-exempt status for a local conservative group and for one that registers voters and tries to get dead people off the rolls. Her attorney, Cleta Mitchell, who provided the timeline above, told me: “These people, they are just regular Americans. They try to get dead people off the voter rolls, you would think that they are serial killers.”

This week Ms. Engelbrecht, who still hasn’t received her exemptions, sued the IRS.

With all the talk and the hearings and the news reports, it is important to keep the essentials of this story in mind.

First, only conservative groups were targeted in this scandal by the IRS. Liberal or progressive groups were not targeted. The IRS leaked conservative groups’ confidential applications and donor lists to liberal groups, never the other way around.

This was a political operation. If it had not been, then the statistics tell us left-wing groups would have been harassed and abused, and seen their applications leaked to the press. There would be a left-wing equivalent to Catherine Engelbrecht.

And all of this apparently took place in the years leading up to the 2012 election. Meaning that before that election, groups that were anti-Obamacare, or pro-life, or pro-Second Amendment or constitutionalist, or had words like “tea party” or “patriot” in their name—groups that is that would support Republicans, not Democrats—were suppressed, thwarted, kept from raising money and therefore kept from fully operating.

That is some kind of coincidence. That is some kind of strangely political, strangely partisan, and strangely ideological “poor customer service.”

IRS officials have complained that the law is murky, it’s difficult to define what the tax exemption law really means. But they don’t have any problem defining it. They defined it with a vengeance.

Second, it is important to remember that there has never been an investigation of what happened in the IRS. There was an internal IRS audit, not an investigation, carried out by an inspector general, who was careful this week to note to the House what he’d done was not an investigation. He was tasked to come to conclusions on whether there had been wrongdoing at the agency. It was not his job to find out exactly why it happened, how and when the scandal began, who was involved, and how they operated.

A dead serious investigation is needed. The IRS has colorfully demonstrated that it cannot investigate itself. The Obama administration wants the FBI—which answers to Eric Holder’s Justice Department—to investigate, but that would not be credible. The investigators of the IRS must be independent of the administration, or their conclusions will not be trustworthy.

An independent counsel, with all the powers of that office, is what we need.

Again, if what happened at the IRS is not stopped now—if the internal corruption within it is not broken—it will never stop, and never be broken. The American people will never again be able to have the slightest confidence in the revenue-gathering arm of their government. And that, actually, would be tragic.

Stay Shocked

So many people are sad about America and cynical about its government. They don’t expect anything good to happen. They think certain poisons have entered the system and nothing can be done about it. Leviathan will not be cut back or tamed, Leviathan will go on abusing the citizen. People are all too willing to believe the Internal Revenue Service is hopelessly political in its judgments and actions. They are not shocked. They don’t think anything can be done, that the system cannot be corrected. They just grip the arms of the seat and wait for the weather to get worse.

But cynicism aids and abets deterioration. You’ve got to stay shocked. It’s disrespectful not to.

It actually is shocking that the IRS appears to have become political and ideological in a way that is systemic. It is shocking that the president claimed he read about the targeting of conservatives just last Friday, in the newspapers, and today the New York Times reports the leadership of the Treasury Department was told the charges were being investigated a year ago.

And it has to be remembered that this is not your ordinary scandal. Your ordinary scandal is an embarrassment. Somebody did something bad and there’s an investigation or hearings. People are made to suffer for their missteps, if only in terms of notoriety and legal expense. Sometimes the innocent or mostly innocent are dragged in, too. But in the end it passes. Some new laws are passed or rules instituted. And we move on to the next scandal. In a government populated by humans there will never be a lack of them.

But the IRS scandal is different because it speaks of the political corruption of a major and crucial governmental agency to whose rules and regulations every American—everyone who has a job or a bank account, or who engages in a financial transaction—is subject. Most people will never have an interaction with the State Department or the Bureau of Labor Statistics, but the IRS deals with an intimate and sensitive part of your life, your personal finances. It is the revenue-collecting arm of the government. It is needed. It does necessary work. When that work is done well it is rarely noted and almost never celebrated. When it’s done badly it’s a terrible thing, because it means a citizen was treated badly or abused. But as an agency it couldn’t be more important to the national mood, the national atmosphere.

If we allow it to become politically corrupt that scandal will not pass, it will be with us every day.

Which gets us to soon-to-be-former IRS chief Steven Miller’s testimony today before the House Ways and Means Committee.

It gave a bit of a shock. He’s the head of an agency accused of major wrongdoing but his attitude was arrogant, nonresponsive, full of gamesmanship. His general tone? I am insulated, baby. You can’t touch me. You can make your little speeches and I’ll endure them with my best approximation of a poker face, but at the end of the day what can you do? I’m leaving. I have a pension. You can’t prove a thing It was so bad that by the end it occurred to me he might be a secret whistleblower who’s trying to enrage Congress into digging in and finding out what really happened to the IRS, and how, and when, and who did it, and what the rest of the administration knew.

Mr. Miller repeatedly suggested his agency hadn’t engaged in political targeting, it was just a matter of “mistakes” made “by people trying to be more efficient in their workload selection.” He said the IRS was guilty of bad “customer service.” He said he had never misled Congress when he testified, previously, that conservative groups were not being targeted: “I answered the questions as they were asked.” He stonewalled and nonanswered. Who started the targeting? “I don’t have that name for you.” This from the head of an agency in a government hell-bent to get to the bottom on this.

There was an interesting moment when Mr. Miller admitted under questioning that the IRS’s seemingly spontaneous public acknowledgement of and apology for the targeting of conservatives was not, really, spontaneous, but part of a spin operation. He provided insight into the new IRS mindset in this exchange with Rep. Tom Price of Georgia:

Price: “Is it illegal what they have done?”
Miller: “It is absolutely not illegal.” . . .
Price: “Do you believe it is illegal for employees of the IRS to create lists to target individuals and groups and citizens in this country?”
Miller: “I think the Treasury Inspector General indicated that it might not be, but others will be able to tell that.”
Price: “What do you believe?”
Miller: “I don’t believe it is.”

Oh. Well that would explain that.

So where does this go? Congress will have more hearings next week. Meaning, I suppose, that more IRS officials will be made momentarily uncomfortable. Also the attorney general, Eric Holder, says the FBI will launch an investigation. The president has said he doesn’t want a special prosecutor to look into the scandal because the investigations of Congress and the Justice Department should be enough.

But they’re not. An independent counsel, with his particular powers and particular independence, is needed.

The targeting of conservative groups and individuals by the IRS was a political operation that had political effects. We know this because only people with certain assumed political views were targeted and abused. No liberal groups were. According to today’s Washington Post, the Barack H. Obama Foundation, run by the president’s half-brother and named after their father, sailed through to tax-exempt status in a matter of weeks.

When a problem is political it’s best to have politically independent people investigate it.

Again, if what happened at the IRS is not stopped now, it will never stop. The next White House will come in and they’ll know they can do it too. And if they’re unlucky enough to be caught, they’ll have a have a few uncomfortable moments in Congress, and a few people who were going to retire in the summer will retire in the spring. And it will all go on.

We are at a point now where you can make a list of things that, all combined and allowed to continue, can kill America. This is one of them. Widespread belief that the revenue-collecting arm of the US government is hopelessly corrupt is one of them.

There is such a thing as national morale. Ours could use a boost. People have grown cynical. They expect nothing good to happen. They expect it all to be swept under the rug. They expect no one to pay a price. It is a matter of profound public need that the U.S. government show and prove that it is capable of correcting itself, that Leviathan can stop itself.

The Inconvenient Truth About Benghazi

The Benghazi story until now has been a jumble of factoids that didn’t quite cohere, didn’t produce a story that people could absorb and hold in their minds. This week that changed. Three State Department officials testifying under oath to a House committee changed it, by adding information that gave form to a growing picture. Gregory Hicks, Mark Thompson and Eric Nordstrom were authoritative and credible. You knew you were hearing the truth as they saw and experienced it. Not one of them seemed political. You had no sense of how they voted. They were professionals. They’d seen a bad thing. They came forward to tell the story. They put the lie to the idea that all questioning of Obama administration actions in Benghazi are partisan and low.

What happened in Benghazi last Sept. 11 and 12 was terrible in every way. The genesis of the scandal? It looks to me like this:

The Obama White House sees every event as a political event. Really, every event, even an attack on a consulate and the killing of an ambassador.

Because of that, it could not tolerate the idea that the armed assault on the Benghazi consulate was a premeditated act of Islamist terrorism. That would carry a whole world of unhappy political implications, and demand certain actions. And the American presidential election was only eight weeks away. They wanted this problem to go away, or at least to bleed the meaning from it.

Because the White House could not tolerate the idea of Benghazi as a planned and deliberate terrorist assault, it had to be made into something else. So they said it was a spontaneous street demonstration over an anti-Muhammad YouTube video made by a nutty California con man. After all, that had happened earlier in the day, in Cairo. It sounded plausible. And maybe they believed it at first. Maybe they wanted to believe it. But the message was out: Provocative video plus primitive street Arabs equals sparky explosion. Not our fault. Blame the producer! Who was promptly jailed.

If what happened in Benghazi was not a planned and prolonged terrorist assault, if it was merely a street demonstration gone bad, the administration could not take military action to protect Americans there. You take military action in response to a planned and coordinated attack by armed combatants. You don’t if it’s an essentially meaningless street demonstration that came and went.

Why couldn’t the administration tolerate the idea that Benghazi was a planned terrorist event? Because they didn’t want this attack dominating the headline with an election coming. It would open the administration to criticism of its intervention in Libya. President Obama had supported overthrowing Moammar Gadhafi and put U.S. force behind the Libyan rebels. Now Libyans were killing our diplomats. Was our policy wrong? More importantly, the administration’s efforts against al Qaeda would suddenly come under scrutiny and questioning. The president, after the killing of Osama bin Laden, had taken to suggesting al Qaeda was over. Al Qaeda was done. But if an al Qaeda offshoot in Libya was killing our diplomats, the age of terrorism was not over.

The Obama White House didn’t want any story that might harm, get in the way of or lessen the extent of the president’s coming victory. The White House probably anticipated that Mitt Romney would soon attempt to make points with Benghazi. And indeed he did pounce, too quickly, the very next morning, giving a statement that was at once aggressive and forgettable, as was his wont.

The president’s Republican challenger was looking for gain and didn’t find it. But here’s the thing. More is expected from the president than mere politics. That’s why we tend to re-elect them. A sitting president is supposed to be bigger, weightier, more serious than his rival.

This week’s testimony from Messrs. Hicks, Thompson and Nordstrom was clarifying, to say the least.

Mr. Hicks, deputy chief of mission at the time of the attack, said the YouTube video was never an event in Libya, and no one in Benghazi or Tripoli saw what was happening as a spontaneous street protest. Beth Jones, the acting assistant secretary of state for Near Eastern affairs, sent an email on Sept. 12 saying: “The group that conducted the attacks, Ansar al-Sharia, is affiliated with Islamic terrorists.” Mr. Hicks himself said he spoke to Secretary of State Hillary Clinton at 2 a.m. Benghazi time the day after the attack and told her it was a planned attack, not a street protest.

Still, the administration stuck to its story and sent out Susan Rice—the U.S. ambassador to the U.N., someone with no direct connection to the event—to go on the Sunday talk shows and insist it was all about a video. They sent someone who could function as a mouther of talking points, someone who was told what to say and could be relied upon to say it. Mr. Hicks said that when he saw what Ms. Rice said his jaw dropped.

All of this is bad enough. Far worse is the implied question that hung over the House hearing, and that cries out for further investigation. That is the idea that if the administration was to play down the nature of the attack it would have to play down the response—that is, if you want something to be a nonstory you have to have a nonresponse. So you don’t launch a military rescue operation, you don’t scramble jets, and you have a rationalization—they’re too far away, they’ll never make it in time. This was probably true, but why not take the chance when American lives are at stake?

Mr. Hicks told the compelling story of his talk with the leader of a special operations team that wanted to fly to Benghazi from Tripoli to help. The team leader was told to stand down, and he was enraged. Mark Thompson wanted an emergency support team sent to the consulate and was confounded when his superiors in Washington would not agree.

Was all this incompetence? Or was it politics disguised as the fog of war? Who called these shots and made these decisions? Who decided to do nothing?

From the day of the attack until this week, the White House spin was too clever by half. In the weeks and months after the attack White House spokesmen said they were investigating the story, an internal review was under way. When the story blew open again, last week, they said it was too far in the past: “Benghazi happened a long time ago.” Jay Carney, the White House press secretary, really said that.

Think of that. They can’t give answers when the story’s fresh because it just happened, they’re looking into it. Eight months later they don’t have anything to say because it all happened so long ago.

Think of how low your opinion of the American people has to be to think you can get away, forever, with that.

Will this story ever be completely told? Maybe not. But it’s not going to go away, either. It’s a prime example of the stupidity of all-politics-all-the-time. You make some bad moves for political reasons. And then you suffer politically because you made bad moves.

The great journalist and political thinker Charles Moore had a briskly intelligent piece in yesterday’s Daily Telegraph on a new biography of Edmund Burke. Everyone who to any degree read his way to conservatism—that is, people who start with experience, with an emerging understanding of the truths of the world around them and then turn to books to help order, deepen and sort through their thoughts—has a political philosopher who more than any other spoke to him. Mine is, was, Burke.

The author of “Edmund Burke,” Jesse Norman, is a member of the British Parliament elected in 2010. Before that he was a writer, and still is. Moore calls him “a rising politician.” His review reminds me of a central difference between British and American political figures, which is that many of the former still operate within an intellectual tradition and are capable of writing and researching books on political philosophers. As if thoughts matter and are part of a continuum. Can you imagine a Republican member of Congress writing such a book, or a Democrat? Our politicians always seem so hackishly unintellectual—anti-intellectual, actually—and ungrounded in anything but the moment.

The Burke book is available for preorder on Kindle, as is Charles Moore’s first volume of his biography of Margaret Thatcher, awkwardly titled to American ears “Margaret Thatcher, from Grantham to the Falklands.” That sounds like a book that’s going to tell you more than you need to know, though Moore in his writings doesn’t do that. The title over here should be “Thatcher, Volume One.” Quick and definitive, like a handbag going THWACK on an erring minister’s head.

The great writer and foreign-affairs thinker Robert Kaplan has a strong piece inThe Atlantic on Henry Kissinger, whom Kaplan sees as a world-class statesman in a league with Castlereagh and Palmerston. Kaplan deftly notes a great challenge to diplomats, which is understanding that whatever the strategy it will be critiqued in the end by artists. And rightly so: “Fernando Pessoa, the early-20th-century Portuguese poet and existentialist writer, observed that if the strategist ‘thought of the darkness he cast on a thousand homes and the pain he caused in three thousand hearts,’ he would be ‘unable to act,’ and then there would be no one to save civilization from its enemies. Because many artists and intellectuals cannot accept this horrible but necessary truth, their work, Pessoa said, ‘serves as an outlet for the sensitivity [that] action had to leave behind.’ That is ultimately why Henry Kissinger is despised in some quarters, much as Castlereagh and Palmerston were.”Kaplan notes a specific domestic political problem faced by Kissinger and Nixon during the Vietnam peace talks: “When Charles de Gaulle was negotiating a withdrawal of French troops from Algeria in the late 1950s and early 1960s (as Kissinger records in Ending the Vietnam War), the Algerians knew that if they did not strike a deal with him, his replacement would certainly be more hard-line. But the North Vietnamese probably figured the opposite—that because of the rise of McGovernism in the Democratic Party, Nixon and Kissinger were all that stood in the way of American surrender. Thus, Nixon and Kissinger’s negotiating position was infinitely more difficult than de Gaulle’s had been. Kissinger found himself caught between liberals who essentially wanted to capitulate rather than negotiate, and conservatives ambivalent about the war who believed that serious negotiations with China and the Soviet Union were tantamount to selling out. Both positions were fantasies that only those out of power could indulge.”

At the end, Kapan attempts to steal a rather major base by characterizing Ronald Reagan’s foreign policy Wilsonian, without bothering to argue why. Boo. But the rest of the piece: great.

Something I read a few weeks ago stays in my mind. Pat Buchanan gave a great speech called “Nixon at 100” at the Richard Nixon Centennial Celebration in Washington on Jan. 9, 2013. The American Conservative published an essay taken from it.

Buchanan covers Nixon as internationalist: “By the end of his first term, all US troops were out of Vietnam, our POW’s were on the way home. . . . He had ended the war with honor, as he promised. He had negotiated and signed the greatest arms limitation treaty since the Washington Naval Agreement of 1922: Salt 1 and the ABM Treaty. He had ended the implacable hostility between the United States and the People’s Republic of China that had endured since Mao’s Revolution and the Korean War. In his second term he would order the strategic airlift that saved Israel in the Yom Kippur War. Israel never had a better friend, said Golda Meir.”

But it is the end of the speech that is most ringing, and most Buchananesque: “As this centennial approached, the phone calls started coming in from the offspring of the old jackal pack, asking my thoughts on Watergate. My great regret is the Old Man is not here tonight so I can tell him my thoughts on his old tormenters. In the words of Nick Carraway to Gatsby: ‘They were a rotten crowd,’ sir. ‘You’re worth the whole damn bunch put together.’”

The freshness of Pat’s resentment, and his epic, gargantuan loyalty to a leader he both saw clearly and loved—these are something to behold.
